Agreement: By downloading, installing, or using VA Benefits App ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and VA Benefits App ("we," "us," or "our"). By accessing or using our mobile application and related services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Service
VA Benefits App is an AI-powered mobile application designed to help veterans, their family members, caregivers, and VSO representatives understand and navigate VA benefits. The App provides:
- Personalized benefit discovery and guidance
- AI-powered chat assistance for VA benefits questions
- Information about disability ratings and claims processes
- Tools for understanding VA math and rating calculations
- Resources for finding accredited VSOs
Important Disclaimer: VA Benefits App is NOT affiliated with, endorsed by, or connected to the U.S. Department of Veterans Affairs (VA). The information provided through this App is for educational and informational purposes only and does not constitute legal, medical, or professional advice.
3. Not Legal or Medical Advice
The content provided through VA Benefits App:
- Is for informational and educational purposes only
- Does not constitute legal advice or create an attorney-client relationship
- Does not constitute medical advice or create a provider-patient relationship
- Should not be relied upon as a substitute for professional consultation
- May not reflect the most current laws, regulations, or VA policies
We strongly recommend that you:
- Consult with an accredited Veterans Service Organization (VSO) for claims assistance
- Verify all information with official VA sources at VA.gov
- Seek professional legal or medical advice when appropriate
4. Eligibility
To use VA Benefits App, you must:
- Be at least 13 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the App under applicable laws
If you are using the App on behalf of a veteran (e.g., as a caregiver or family member), you represent that you have the authority to accept these Terms on their behalf.
5. User Accounts
5.1 Account Creation
To access certain features, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
5.2 Account Responsibilities
You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
6. Acceptable Use
You agree NOT to:
- Use the App for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Submit false or misleading information
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to our systems
- Use automated systems (bots, scrapers) without permission
- Reverse engineer or decompile the App
- Remove or alter any proprietary notices
- Use the App to harass, abuse, or harm others
7. Intellectual Property
7.1 Our Content
The App and its original content, features, and functionality are owned by VA Benefits App and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
7.2 Government Content
The App references and incorporates information from public government sources, including 38 CFR, the M21-1 Adjudication Manual, and BVA decisions. Such government content is in the public domain.
7.3 User Content
You retain ownership of any content you submit through the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display such content for providing our services.
8. Subscription and Payments
8.1 Free and Premium Tiers
VA Benefits App offers both free and premium subscription tiers. Premium features may include:
- Ad-free experience
- Unlimited AI conversations
- Priority customer support
- Advanced rating analysis tools
8.2 Billing
Premium subscriptions are billed through the Apple App Store or Google Play Store according to their terms. Subscription fees are non-refundable except as required by applicable law or store policies.
8.3 Cancellation
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of your current billing period.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF INFORMATION
We do not warrant that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- The information provided will result in successful VA claims
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VA BENEFITS APP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, or goodwill
- Any damages resulting from your use or inability to use the App
- Any damages resulting from unauthorized access to your account
- Any damages related to VA claims outcomes
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless VA Benefits App and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any content you submit through the App
12. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Modifications to the App
We reserve the right to:
- Modify or discontinue any feature of the App
- Change subscription pricing with reasonable notice
- Update the App to address bugs or security issues
We are not liable to you or any third party for any modification, suspension, or discontinuance of the App.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
- Sending an email notification for significant changes
Your continued use of the App after changes constitutes acceptance of the new Terms.
15. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:
- Your right to use the App ceases immediately
- We may delete your account and data
- Provisions that should survive termination will remain in effect
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.
17. Dispute Resolution
17.1 Informal Resolution
Before filing any claim, you agree to contact us at legal@vabenefitsapp.com to attempt to resolve the dispute informally.
17.2 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and VA Benefits App regarding the use of the App.
